GENERAL INFORMATION
1.1 These general terms and conditions of sale (hereinafter, ‘General Terms and Conditions’) apply to all sales of products (hereinafter, ‘Products’ or “Product”) purchased through the website www.donnafrancesca.it (hereinafter, ‘Website’).
1.2 The use of the distance selling service described in these General Terms and Conditions is reserved exclusively for consumers (hereinafter referred to as ‘Customers’ or the ‘Customer’), understood as natural persons acting for purposes unrelated to their commercial, entrepreneurial or professional activities, if any.
1.3 The languages available for concluding the contract are Italian and English.
1.4 The Customer is required to carefully read the General Terms and Conditions, which have been made available on the Website in a format that allows them to be stored and reproduced by the Customer.
1.5 Contracts concluded with Sapori in Corso Srl (as identified below) through the Website are governed by Italian law and, in particular, by Legislative Decree No. 206 of 6 September 2005 (hereinafter also referred to as the ‘Consumer Code’), Legislative Decree No. 70 of 9 April 2003 (hereinafter also referred to as the ‘E-commerce Decree’) and, where applicable, Royal Decree No. 262 of 16 March 1942 (hereinafter also referred to as the ‘Civil Code’).
1.6 Sapori in Corso Ltd reserves the right to change the General Terms and Conditions of Sale by giving notice on this page of the website. The applicable General Terms and Conditions of Sale are those in force at the time an order is placed. Any changes will be effective after publication on the website.

PRODUCT INFORMATION
3.1 Information regarding Products available for remote sale through the Website is available, together with the relevant product codes, on the Website www.donnafrancesca.it.
3.2 Product images may not be perfectly representative of their characteristics but may differ in colour, size and accessories shown. All supporting information for purchasing is to be understood as simple generic information material, not referable to the actual characteristics of a single product.
PRICE
4.1 Product prices are inclusive of all taxes and duties except for customs duties and other charges that may be applied by the customs authorities of the country of destination.
4.2 All prices are quoted in Euro.
4.3 Shipping costs are borne by the customer, except in the case of promotions.
PRODUCT PURCHASE
5.1 The essential characteristics and prices of the Products are set out in the offer relating to each Product.
5.2 Orders from persons who are not of legal age will not be accepted.
5.3 To purchase Products, the Customer must complete and submit the order form online in electronic format. Registration with a username and password is optional. If the Customer does not wish to register, they may still complete a purchase: only the data necessary for delivery and any invoicing of an order will be requested.
5. 4 The Customer must place the Product in the appropriate ‘shopping cart’, enter their personal details, enter the shipping details and, after reading the General Terms and Conditions, with particular reference to the contribution for delivery costs, the methods for exercising the right of withdrawal and the Privacy Policy, and confirming that they have read them, must select the desired payment method and choose the ‘Confirm order’ option.
5.5 Before submitting their purchase order, the Customer will have the opportunity to correct any errors in the data entered by following the specific modification procedure contained on the Website. In particular, the Customer has the right to modify the quantity and type of Products they intend to purchase by adding or removing one or more Products from the ‘shopping cart’.
5.6 By submitting the order, the Customer acknowledges and declares that they have read all the information provided during the purchase process and fully accept the General Terms and Conditions.
5.7 Sapori in Corso Ltd reserves the right to evaluate the acceptance of orders received. Sapori in Corso Ltd will notify the Customer if it is unable to accept the orders received within 30 days from the day following the date on which the Customer placed the order and will refund any sums already paid by the Customer for the supply.
5.8 No contract shall be deemed to have been concluded between Sapori in Corso Srl and the Customer if Sapori in Corso Srl has reasonable grounds to believe that the Customer is not acting on the basis of a genuine interest in purchasing the products ordered. In such cases, the order submitted by the Customer shall be deemed to be null and void. Sapori in Corso Srl will send the Customer an email confirming that the Contract has not been concluded and will also cancel any charges and/or expenses incurred by the Customer.
PAYMENT METHODS
6.1 The Customer may pay for the Products and the related delivery costs by credit card.
6.2 Payments made by credit card are accepted.
6.3 The transaction will only be charged to the Customer’s linked account after: a) the data has been verified (on a secure server directly by the Bank; Sapori in Corso Srl will not have any direct access to your data), b) authorisation for the charge has been received from the company that issued the credit card used by the Customer, and c) the availability of the Product has been confirmed by Sapori in Corso Srl.
6.4 If, for any reason, it proves impossible to charge the amounts owed by the Customer, the sales process is automatically cancelled and the sale is automatically cancelled.
ORDER RECEIPT
7.1 Upon receiving an order, Sapori in Corso Srl will automatically send a confirmation of receipt by email, which will summarise all the details of the order, the essential characteristics of the product ordered, its price, the amount paid, the existence of the right of withdrawal – with an indication of the times and methods for returning the goods – the geographical address for submitting any complaints and information on assistance services and existing commercial guarantees.
7.2 Upon receipt of an order, Sapori in Corso Srl will verify the availability of the product ordered and the existence of the other conditions for sale, and only after such verification will it communicate its acceptance of an order and the shipment of the product.
7.3 In the event that Sapori in Corso Srl is unable to fulfil an order received, it shall promptly notify the Customer.
7.4 The customer shall have no right to compensation for damages or indemnification, nor shall there be any contractual or non-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance of an order.
SHIPPING AND DELIVERY
8.1 Products purchased on the Website will be delivered to the address specified by the Customer. The Customer may, in any case, request delivery of the products to a natural person of their choice. Deliveries will not be made to PO boxes.
8.2 For each order placed on the Website, Sapori in Corso Srl issues an invoice for the goods shipped, sending it together with the package or by email. The information provided by the Customer when placing the order is used to issue the invoice. No changes can be made to the invoice after it has been issued.
8.3 Delivery costs are borne by the Customer and are clearly indicated on the Website and in the order form.
8.4 All purchases will be delivered by express courier with whom Sapori in Corso Srl has entered into collaboration agreements (hereinafter, ‘Courier’) from Monday to Friday, excluding holidays and national holidays. Sapori in Corso Srl is not responsible for unforeseeable delays. Sapori in Corso Srl will send the Customer a confirmation email once the Products have been shipped. In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, the Products will be delivered within 10 (ten) days, except in the event of delays and in any case no later than 30 (thirty) days from the day following that on which the Customer placed the order with Sapori in Corso Srl.
8.5 The delivery times indicated for the goods are approximate.
8.6 For the delivery of the goods, the Customer or a person appointed by him must be present at the address indicated in the order. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to that indicated in the delivery document and that the package is intact and has not been tampered with. Any damage to the package and/or the Products or any discrepancy in the number of packages must be immediately reported by means of a written note on the courier’s proof of delivery. Once the courier’s document has been signed, the Customer may not make any objection regarding the external characteristics of the package delivered.
TARIFFS AND RESTRICTIONS
9.1 Sapori in Corso Ltd. is not responsible for any duties or purchase restrictions applied by the customs authorities of the destination countries.
RIGHT OF WITHDRAWAL
10.1 In accordance with the provisions of Legislative Decree No. 21 of 21 February 2014, implementing Directive 2011/83/EU on consumer rights, the Customer may return the purchased product and obtain a refund of the purchase price actually paid, without penalty and without specifying the reason.
10.2 The right of withdrawal consists of the right to return the purchased products to the seller and consequently obtain a refund of the purchase price of the products themselves.
10.3 The right of withdrawal may be exercised within 14 days of receipt of the product in the following ways:
10.3.1 Before the expiry of the aforementioned term, the Customer shall send a registered letter with return receipt to Sapori in Corso Srl or submit another declaration explicitly stating their intention to withdraw. The communication may be sent, within the aforementioned deadline, by registered letter to the address Via Le Matine, s.n. 70032 – Mariotto, BA – Puglia – Italy or by email to the address: [email protected].
10.3.2 Once Sapori in Corso Srl’s customer service department has verified the conditions for exercising the right of withdrawal, it will contact the consumer to indicate the location where the products must be returned intact within fourteen days, excluding holidays and weekends, starting from the date of notification of withdrawal.
10.4 The costs of returning purchased products shall be borne by the consumer.
10. 5 If the value of the products has decreased due to handling other than that necessary to establish the nature, characteristics and functioning of the products (for example: damaged products, products not properly or completely packaged, or products in which certain parts are missing or damaged, such as components, elements, accessories, packaging materials, boxes, documentation and/or other items), Sapori in Corso Srl will refund the Customer the purchase price minus the value of said decrease.
10.6 If the Customer returns products after the above deadline or in the case of opened and/or partially used products that cannot be returned, the right of withdrawal does not apply and Sapori in Corso Srl will return the purchased goods to the Customer, charging them for the shipping costs.
10.7 Subject to the above limitations, Sapori in Corso Srl will refund the amount actually paid by the Customer within 14 days of receiving the notice of withdrawal, by bank transfer.
CONFORMITY DEFECTS, WARRANTY AND REPLACEMENT
11.1 The legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code apply to the sale of non-food products. To benefit from the guarantee, the customer must keep the invoice or, if this does not exist, the transport document.
11.2 In the event of conformity defects in Products sold by Sapori in Corso Srl, the Customer must immediately contact Customer Service at the email address [email protected].
11.3 The Customer is entitled to have the goods brought into conformity free of charge by replacement or to an appropriate price reduction or to termination of the contract.
11.4 The Customer forfeits these rights if they do not report the lack of conformity to Sapori in Corso Srl within two months of the date on which they discovered the defect. In any case, the right to take action to enforce defects not maliciously concealed by Sapori in Corso Srl expires twenty-six months after delivery of the goods.
11.5 If the purchased product has been damaged during transport, the Customer may request its replacement within 10 days of receipt.
11.6 The Product to be replaced must be sent, in normal condition, to the following address: Sapori in Corso Srl, Via Le Matine, s.n. 70032 –Mariotto, BA – Puglia – Italy.
11.7 The fulfilment of the new order is subject to the availability of the requested Products.
ERRORS
12.1 The information relating to the Products provided on the Website is constantly updated. However, it is not possible to guarantee that there are no errors.
12.2 Sapori in Corso Ltd reserves the right to correct errors, inaccuracies or omissions even after an order has been placed, and also to change or update information at any time without prior notice.
APPLICABLE LAW AND JURISDICTION
13.1 These General Terms and Conditions are governed by Italian law and must be interpreted in accordance with Italian law.
13.2 For disputes arising from the interpretation, validity and/or execution of these General Terms and Conditions, the Court of Bari shall have exclusive jurisdiction.
